Restaurant Partner Terms of Service

These terms govern participation in the BringItBack Reuse System as a Restaurant Partner ("Partner," "you"). They apply to your use of the Partner portal at bringitback.nyc/partner and to your handling of BringItBack containers. By joining the program or using the Partner portal, you agree to these terms. This agreement is between your business and BringItBack ("we," "us").
The partnership
As a Restaurant Partner, you serve customer meals in reusable stainless-steel BringItBack containers and accept the return of any BringItBack container, whether or not the customer bought their meal from you. We supply containers, wash and sanitize them at our facility, coordinate pickups and deliveries, and operate the rewards and tracking system. Participation is free for the duration of the pilot unless we agree otherwise in writing.

Containers remain ours
All BringItBack containers remain the property of BringItBack at all times. While containers are in your possession, you agree to use them only as part of the BringItBack reuse system, including serving food to customers and accepting returned containers. Containers may not be sold, intentionally discarded, repurposed, or permanently retained.
Restaurant Partners are not responsible for containers that are lost, damaged, or not returned by customers after being issued through the BringItBack system.
A Partner may be responsible for replacement costs only when containers are lost, intentionally discarded, knowingly withheld, or damaged beyond normal wear and tear while under the Partner's control. We will communicate any replacement cost before invoicing.

Your responsibilities
You agree to store BringItBack containers in a clean, food-safe manner; accept returned BringItBack containers during your normal business hours, regardless of which Restaurant Partner originally issued them; and keep returned containers available for BringItBack pickup.
You agree to serve food in BringItBack containers in compliance with applicable New York City and New York State food-safety requirements.
You are responsible for the food you prepare and serve. BringItBack is responsible for commercially washing and sanitizing containers before they are returned to circulation.
If a container appears damaged or unclean, do not serve food in it. Set it aside for BringItBack instead.

Orders, deliveries & pickups
Through the Partner portal, you can request container deliveries and adjust an order before it is fulfilled.
Container delivery requests will be fulfilled for the quantity requested. You do not need to request a pickup or count returned containers. Simply keep returned containers together and available for collection, and BringItBack will collect them.
We aim to fulfill delivery requests and collect returned containers promptly but do not guarantee a specific delivery or collection time during the pilot.
Delivery and pickup records shown in your Partner portal reflect BringItBack's operational records and may be corrected if a recording error is discovered.

The Partner portal
Access to the Partner portal is protected by an 8-digit one-time passcode (OTP). Keep your login code private and do not share it with anyone who is not authorized to access the portal on behalf of your business.
If you believe someone has accessed your Partner portal without authorization, contact BringItBack as soon as possible.
The Partner portal is provided solely for managing your BringItBack partnership. You agree not to attempt to access another Partner's data, interfere with the portal, probe the system for vulnerabilities, or use it for purposes unrelated to your BringItBack partnership.

Messages
The Partner portal includes a messaging channel between your business and the BringItBack team for coordinating deliveries, pickups, container issues, and other program operations. Messages are associated with your business record and may be retained as part of our operational records.
We may also contact your business using the contact information you provide, including by email, telephone, or postal mail, for account, order, service, and program-related communications, as described in the Restaurant Partner Privacy Policy.

Fair dealing
You agree to represent BringItBack honestly to customers, not to charge customers a fee for returning a BringItBack container, and not to knowingly manipulate delivery, pickup, return, or other program records. We agree to deal with you honestly and fairly as well.
Either you or BringItBack may end the partnership at any time, for any reason, with reasonable notice. When the partnership ends, you agree to make any BringItBack containers remaining at your business available for collection, and we will arrange to collect them.

No guarantee; limitation
The BringItBack program and Partner portal are provided on an "as is" and "as available" basis during the pilot. We may modify, suspend, or discontinue features or services as the program develops. When practical, we will provide reasonable notice of changes that materially affect your participation.
To the fullest extent permitted by law, BringItBack will not be liable for indirect, incidental, special, or consequential losses arising from your participation in the program or use of the Partner portal.
These limits apply only where the law allows them.

The fine print
We may update these Terms as the program develops. If a change materially affects your participation, we will provide reasonable notice through the Partner portal or using the contact information you have provided. Continued participation after the updated Terms take effect means you accept the changes.
These Terms are governed by New York law. If any part of these Terms is found unenforceable, the rest will remain in effect.
